Who will consider Dubnevych's case? The lawyer claims illegal appointment of the judge of VAKS
Lawyer Volodymyr Bohatyr assures that the appointment of judge Yekaterina Sikora to consider the 'gas case' of people's deputy Yaroslav Dubnevych was unacceptable under the law. According to him, the automatic distribution of cases should occur on the principle of randomness, but in this case, this principle was violated, as the judge was determined to be a person with less workload who was considered less busy.
The foundations of the system include a comprehensive list of reasons when a judge cannot be appointed to consider a case, including periods of vacations, business trips, incapacity for work, and educational activities. In this case, the judge was supposed to undergo training, but the system did not exclude her from the distribution, which raised doubts about compliance with the principles of randomness and transparency.
'Every violation of automated distribution is a crack in the foundation of the judicial system. Especially when it came to VAKS, which was supposed to be a model of virtue,' emphasized Bohatyr.
The lawyer urged law enforcement agencies to investigate possible interference in the activities of the judicial authorities to ensure honesty and transparency in the consideration of cases.
