What to Do When Your Military Deferral Request Faces Delays
Processing Deferral Requests from Military Conscription
According to ХВИЛЯ: Attorney Yuriy Aivazian has clarified the legally mandated deadlines for Territorial Recruitment Centers (TCCs) to process deferral applications and the steps to take if they are missed. According to the expert, a deferral request must be reviewed within 7 calendar days of its receipt by the TCC. If the commission has sent inquiries to other state bodies, a final decision must be made no later than the next working day after the necessary information is received.
State institutions that receive such inquiries from TCCs are given 5 working days to process them. Should a decision on the deferral not be made after all these deadlines have passed, the citizen has the right to challenge the inaction of the TCC, including through the courts.
'Once all these deadlines have expired and no deferral decision has been made, the citizen gains the right to challenge the inaction of the TCC and other structures-specifically, through legal proceedings.' Yuriy Aivazian
Advice from Human Rights Advocates
Human rights defenders recommend submitting the application through the TCC office with a formal receipt or sending it via registered mail to officially document the start date of the review period. This can be a crucial step for any subsequent legal action. Such measures can help citizens protect their rights and ensure TCCs adhere to the legal timelines.
This guidance is vital for citizens planning to apply for a conscription deferral, as it outlines the clear deadlines within which TCCs must make their decisions. Understanding one's rights and the mechanisms for appealing inaction can significantly impact the defense of the interests of those subject to conscription. In the current wartime context, it is essential for citizens to be informed of their legal rights and the means to enforce them.
