How to restore real estate documents

The Ministry of Justice of Ukraine explained to citizens how to obtain lost real estate documents. Due to Russian aggression in Ukraine, the number of cases where people lose or cannot access documents related to their housing has increased.

The absence of such documents can complicate any real estate transactions, from sales to inheritance.

Where the housing documents are located:
  • in the files of the state notary office;
  • in the state notarial archive;
  • with the private notary who issued the document.

If the notary has ceased operations, duplicates can be obtained from the notarial archive at the location where the documents are stored.

'In the event of inability to obtain a duplicate due to loss of access to the documents of notarial proceedings and the archive of the private notary or state notary office, the person may apply to the court with a claim for the recognition of ownership rights to the property.'

In addition to the owner, duplicates can be obtained by heirs, successors, mortgage holders, or executors of the will provided there is a corresponding application and documents confirming their status.
