Apple first raised its concerns with OpenAI back in February. It is known that more than 400 former Apple employees now work at OpenAI. A deal to integrate ChatGPT into iOS was signed in 2024. Additionally, OpenAI acquired Jony Ive's startup io for $6.4–6.5 billion and is developing its own smartphone, with production expected to begin around 2028.
The plaintiff demands a jury trial, compensation for damages, a ban on OpenAI's further use of the stolen secrets, destruction of any materials already obtained, and a redesign of OpenAI's products that rely on that information. In its filing, Apple asserts that 'this is just the tip of the iceberg.'
Market reaction to the lawsuit has been mixed. On the day the suit was filed, Apple shares closed at $315.32, down 0.28%. However, in the week prior, Apple's stock had risen by 2.17%. According to FactSet, the average analyst price target stands at $317.88. Meanwhile, Elon Musk commented on the news, saying,
'sounds not very good for the company.'
