According to Главком: The Council of the National Assembly of Belarus has passed a draft law prohibiting what it terms 'LGBT propaganda' and the promotion of voluntary childlessness. Titled 'On Amendments to the Codes on Administrative Liability,' this legislation introduces nine new articles and 43 new categories of administrative offenses into the Belarusian Code of Administrative Offenses. It also makes 73 amendments to existing offense categories.

Scope and Penalties of the New Legislation

A particularly contentious provision bans the 'propagation of homosexual relations, sex change, childlessness, and pedophilia.' This article establishes a tiered system of fines for different entities:

  • Fines for individuals can reach up to 20 base units, approximately $300.
  • Individual entrepreneurs face fines of up to 100 base units, around $1,500.
  • Legal entities can be fined between 100 and 150 base units, amounting to a maximum of $2,200.

Penalties become significantly harsher if the prohibited information reaches minors, potentially resulting in increased fines, community service, or administrative detention for citizens. This law is part of a broader regional trend of tightening restrictions on LGBTQ+ rights and expression.

The updated code will take effect after being signed by President Alexander Lukashenko. Previously, the Belarusian Ministry of Culture equated the depiction of 'non-traditional relationships' to pornography, the distribution of which is already illegal. Meanwhile, the European Commission has reiterated that Ukraine's path to EU membership requires the legalization of same-sex partnerships. This statement was a response to inquiries from several Ukrainian human rights organizations regarding Ukraine's draft Civil Code.

The adoption of this law in Belarus highlights an increasingly restrictive legal environment for the LGBTQ+ community, with potential profound societal impacts.
