The Supreme Court prohibited the use of ChatGPT as evidence in court: ruling of the panel
Artificial Intelligence in the Judicial System
According to glavcom.ua: The judges of the Cassation Economic Court decided that artificial intelligence should only be an auxiliary tool in justice. Technology should support the law and assist judges, rather than replace them or sources of evidence.
In a case where the city council sued a company over changes to a land lease agreement, the court's decision was made only partially. The appellate and cassation courts upheld this decision, rejecting the use of electronic evidence. They explained that artificial intelligence cannot be the basis for judicial resolution.
The judges determined that only people should make judicial decisions; this cannot be delegated to technology in order to preserve judicial independence.
This is not the first time that artificial intelligence has been used in justice in Ukraine. Earlier, a state service with the support of artificial intelligence was launched for automatic document verification when obtaining veterinary licenses in 'ePermits'.
The courts' decisions indicate that the judicial system of Ukraine is exploring the possibilities of using cutting-edge technologies, but even here it is better to leave specific rulings solely to live judges.
