Government Appeals Court Ruling for Pensioners, Delaying Payments Once More
Pension Payment Issues Persist
According to ХВИЛЯ: Millions of pensioners who won court cases against the Pension Fund are still not receiving their full pensions. The situation has been complicated by an appeal filed by the Cabinet of Ministers on April 14, 2026, challenging a ruling from the Kyiv District Administrative Court made on March 4. That court had declared Resolution No. 821, which took effect on July 17, 2025, unlawful and invalid. This legal battle centers on a government resolution that created a separate budgetary category for court-ordered pension recalculations, a move which has effectively stalled the disbursement of owed funds. This ongoing dispute highlights a systemic tension between judicial orders and government budgetary processes.
Budgetary Separation and Official Commentary
The 2026 budget of the Pension Fund continues to list court-mandated supplementary payments under a distinct, separate line item, confirming that the delay in payments remains a deliberate policy.
Tetiana Holytsia: 'The appellate challenge stage does not nullify our victory; it is merely the next round.'
She further emphasized that 'the longer you wait, the more you postpone the date of receiving your pension in full.'
Consequently, despite a favorable court ruling for pensioners, their right to receive full pensions continues to be violated due to protracted administrative and legal procedures. The prospect of resolving this situation is causing significant concern among those awaiting payments. This issue not only underscores flaws in the payment system but also raises serious questions about the judiciary's effectiveness in enforcing social guarantees for citizens.
The ongoing challenges faced by pensioners are further illustrated by the Ukrainian Pension Fund's failure to disburse the full amounts mandated by court rulings. This situation not only exacerbates the financial strain on retirees but also raises critical questions about the government's commitment to honoring judicial decisions. Understanding these dynamics is crucial for those affected and for the broader discussion on pension reforms in the country.
