The International Criminal Court and Russian Aggression in Ukraine

According to ХВИЛЯ: The International Criminal Court (ICC) may temporarily suspend the investigation of Russian aggression in Ukraine if the UN Security Council makes such a decision. ICC Deputy Prosecutor Najat Hamimi Khan stated that the investigation into the Russian invasion of Ukraine cannot be stopped by peace negotiations, but it can be postponed in accordance with the decisions of the Security Council.

Najat Hamimi Khan noted that if the investigation is already ongoing, the court operates according to its regulatory framework. She also emphasized that the Security Council has the right to ask the court to postpone the case if it believes there is a possibility for a peace agreement. At the same time, the discussion can only be about a temporary suspension of the investigation.

The Situation with Arrest Warrants

The ICC has already issued arrest warrants for Russian President Vladimir Putin and five others for their involvement in war crimes in Ukraine. However, the Kremlin does not recognize the jurisdiction of the International Criminal Court and considers the warrant invalid. Thus, the situation surrounding the investigation remains complex and dynamic.
