Draft Law on 'Simple Associations' for Apartment Buildings

According to ХВИЛЯ: A new legislative proposal from Ukraine's Ministry for Communities and Territories Development is causing alarm among housing experts. The bill would mandate the creation of 'simple associations' in apartment buildings that lack a formal homeowners' association (known as an OSBB). Oleg Popenko, a specialist in the field, has warned that a key provision allowing for the appointment of an external building manager creates a significant risk of hostile property takeovers, a practice known as 'raiding' in Ukraine.

Under the draft law's concept, if residents of a multi-unit building do not form an OSBB, an external manager will be appointed for them. This state-appointed manager would gain the authority to sign contracts on behalf of all co-owners, a power experts say is ripe for abuse. Popenko pointed out that similar mechanisms have already been exploited in the capital, Kyiv, by specialized organizations to seize control of buildings.

Potential Risks for Residents

Popenko cautioned that the situation could deteriorate further. He emphasized that forming a formal OSBB remains the superior option for residents, as it empowers them to advocate for their interests and negotiate collectively. 'In that case, it's better to choose and create an OSBB, to fight somehow, to start negotiating with each other,' the expert stressed.

Consequently, the proposed legislation has sparked serious concern over the potential for residents to lose control of their property. This legal framework is particularly sensitive in Ukraine, where property rights have sometimes been vulnerable to exploitation. The draft law, by enabling the appointment of external managers, threatens residents' rights and could facilitate abuses. Given the history of property raids, it is crucial for the public and lawmakers to heed expert advice promoting the formation of homeowner associations.
