Prosecutors Challenge Medical College Leases: Barbershop and Workshop Occupy Classrooms
Lease Agreements for Kyiv's Premier Medical College Face Legal Challenge
According to Прокуратура Київ: Kyiv's prosecutors have initiated a court challenge against the lease agreements for premises belonging to the First Kyiv Specialized Medical College. The legal action follows the discovery that a barbershop and a repair workshop were operating in the leased spaces, a clear violation of Ukraine's 'On Education' law. This legislation explicitly prohibits the use of state and municipal educational property for non-educational purposes. Such legal protections are common in many countries to safeguard public educational resources.
Court Proceedings and Prosecutorial Action
Prosecutors from the Shevchenkivskyi District Juvenile Prosecutor's Office in Kyiv have filed lawsuits with the Economic Court. They seek to have the rental contracts declared invalid and to secure the return of the college's property. The leased areas had been converted into a barbershop with a tanning salon and a clothing repair workshop, prompting intervention from law enforcement. The Kyiv Economic Court has already opened proceedings in response to one of the prosecutor's claims.
This case underscores the critical importance of adhering to legal statutes governing the use of state property, particularly within the educational sector. According to the law, educational institution assets must be used exclusively for their intended purpose, which precludes any commercial activity on the premises. The court's eventual ruling is anticipated to influence future practices regarding the utilization of state resources in educational institutions across the country.
