According to Главком: A court in Khmelnytskyi has granted a second postponement for a mother of four convicted of bribery, delaying her prison sentence until her youngest child turns three. The original sentence, which became final in December 2023, mandates a four-year prison term and the confiscation of 2,000 hryvnias for the state. This case highlights the complex interplay between criminal justice and family rights in Ukraine's legal system.

The woman was found guilty of offering an improper benefit to a public official. She attempted to bribe a senior investigator with $1,000 USD to close a criminal case regarding a theft. During a meeting, she placed 2,000 hryvnias inside the investigator's notebook. At the time of her original conviction, she already had three minor children.

Requests for Sentence Deferral

The convicted woman did not appeal the sentence. In mid-January 2024, she filed a petition to defer the sentence, which the court granted, postponing its execution until March 31, 2026. On March 30, 2026, she submitted a new petition, as she had given birth to a fourth child in October 2025. The court ruled to delay the sentence execution until October 3, 2028, coinciding with her infant son's third birthday.

The court based its decision on Article 536 of Ukraine's Criminal Procedure Code and referenced a ruling from the European Court of Human Rights in the case of Chizhov v. Ukraine. That ruling states,

"the State has a positive obligation to organise its judicial system in such a way as to ensure the execution of judgments without any unjustified delay, and in such a way that the system is effective both in law and in practice"

(European Court of Human Rights).

Consequently, the court continues to consider deferring the sentence, taking into account the evolving family circumstances of the convicted individual.
