According to ХВИЛЯ: The Ukrainian government has overhauled the rules for developing private land plots, streamlining the approval process for small-scale construction while tightening regulations concerning neighbors' rights and environmental protection. These changes were enacted by Cabinet of Ministers Resolution No. 305 on March 4, 2026. This reform is part of a broader effort to modernize the country's construction sector and align it with European standards.
Under the new framework, the procedure for constructing houses up to 200 square meters in area and two stories high has been significantly simplified. The requirement for a formal construction passport for such projects has been eliminated. Instead, developers must prepare a 'development intent scheme,' which can only be drafted by certified architects or engineers. This scheme must detail the building's location, facade plans, and connection points to utility networks. A key innovation is that data from these schemes is now entered into a state electronic system, ensuring greater transparency for the entire process.
New Prohibitions and Requirements
Furthermore, the new regulations prohibit the erection of tall fences or structures that could block sunlight or impede ventilation for neighboring properties. A ban is also established on construction work that could lead to the flooding of adjacent plots or create excessive noise. These measures aim to prevent common disputes in residential areas.
As experts note, 'now, instead of a lengthy process of collecting various certificates, it is sufficient to have a development intent scheme. It is prepared by a certified architect or engineer-qualified professionals in the field.'
Thanks to the new rules, data is fed into the state electronic system immediately. Experts believe this is 'much faster; however, the state now sees every stage of construction in real time.' This is expected to enhance oversight and ensure compliance with established development norms.
