Deferral without the Military Medical Commission: when the Territorial Recruitment Center has no right to send for a commission

Lawyer Daria Tarasenko explained to Ukrainians on her Facebook page that referral to the military medical commission (VLC) is not mandatory when submitting an application for deferral to the territorial recruitment center.

Many conscripts fear that a visit to the Territorial Recruitment Center for obtaining a deferral will inevitably end with a referral to the VLC.

Tarasenko emphasizes that the lack of a fresh conclusion from the VLC is not a basis for refusing to accept the deferral application or the deferral itself. According to the Cabinet of Ministers' resolution of 16.05.2024 No. 560, persons who have submitted an application for deferral should not be sent to the VLC.

  • If the last conclusion of the VLC indicates the category 'conditionally fit';
  • If the conscript was temporarily deemed unfit for a certain period that has already ended.

In all other cases, demand that the Territorial Recruitment Center accept the deferral application and obtain confirmation of the document receipt. If your status is 'conditionally fit' or temporary unfitness has already passed, refusal to undergo the VLC will be a violation of the law.
