The Verkhovna Rada legalizes the reservation for those not on military registration
According to hvylya.net: The Verkhovna Rada is discussing a draft law that will allow the reservation of even those men who ignored the military registration requirements at critically important enterprises. The Committee on National Security recommended adopting the reservation law in the second reading.
The document provides that during the period of up to 45 calendar days, even those who: do not have military registration documents or have improperly arranged them, are not registered for military service at all, have not clarified personal data, are wanted for violations of military registration or mobilization legislation will be subject to reservation.
According to information from the Judicial and Legal Newspaper, reservations will be granted regardless of the number of already reserved employees, but no more than once a year for each individual. However, in the Main Legal Department of the Verkhovna Rada, they note that the adoption of such a law may lead to the leveling of legal responsibility.
Probation period for employees at enterprises
The draft law also provides for the establishment of a probation period of up to 45 days for employees who fall under reservation. If during this time the employee does not bring his military registration documents into compliance, the employer will have the right to dismiss him. However, lawyers note that the probation period cannot be used as a means of coercion to fulfill military obligations.
This approach does not solve the problem of staff shortages, as in the event of non-compliance with the requirements, the employer loses the opportunity for further employment of the employee
It should also be noted that a Unified Register of Military Obligors has been launched in Ukraine, which the Territorial Recruitment Centers receive data from.
