According to Главком: A court in Kharkiv has ordered a Territorial Recruitment Center (TCC) to remove an individual from the military register following their gender transition. This marks the first case in Ukraine where a person has been deregistered after a legal change of gender. The Kharkiv District Administrative Court reviewed the case, in which the plaintiff provided a medical certificate confirming the gender change. Supporting documents, which show the amendments to the civil status record, are dated January 2025.

After obtaining a new passport, the plaintiff requested the TCC to remove her from the military register. However, the TCC refused, demanding she undergo a military medical commission. The court ruled this refusal unlawful and ordered the TCC to remove the plaintiff from the military register and the Oberih registry. This ruling is significant as it sets a legal precedent for transgender rights in Ukraine, a country where military service rules are particularly stringent due to the ongoing conflict.

Case Involving a Clergyman

In a separate case, the Stryi City District Court in the Lviv region convicted a 47-year-old clergyman from the Jehovah's Witnesses organization for unauthorized abandonment of his military service post. Under Ukraine's current martial law, all eligible citizens are obligated to fulfill military duty. This conviction highlights the strict enforcement of mobilization laws, even as other cases test their boundaries and application.

The Kharkiv ruling carries substantial implications for the legal status of transgender individuals in Ukraine, potentially establishing a precedent for similar cases. Given that military registration operates under special rules during martial law, the court's decision may influence future practices at recruitment centers.
