Beneficiaries will be forced to return money through the court: the Pension Fund of Ukraine made an important statement

The Pension Fund of Ukraine urges citizens to be careful when receiving benefits for housing and communal services and to timely report any changes in circumstances. This was reported by the agency, reminding about the possible consequences of violating the established procedure.

According to the Pension Fund, benefits for housing and communal services are received by veterans, pensioners, large families, and other categories of citizens defined by law. However, incorrect registration or concealment of important facts can lead to serious financial consequences.

'A beneficiary is obliged to inform the Pension Fund about changes that affect their right to benefits. Failure to notify in a timely manner may lead to overpayment,' the agency notes.

The greatest number of problems arises from the submission of false information or the concealment of changes in personal circumstances. The Pension Fund explains that overpayment of benefits is an excess allocation of budgetary funds received without sufficient legal grounds.

The mechanism for granting benefits is regulated by a special procedure established by the resolution of the Cabinet of Ministers of Ukraine dated April 17, 2019, No. 373. This document describes in detail not only the procedure for receiving assistance but also the conditions for its termination and the return of overpaid amounts.

Special attention should be paid to the circumstances affecting the amount of the benefit. This may involve a change in the category of the beneficiary, a change in the composition of the family to which the benefits apply, or even a change in the manager of the building or the provider of communal services. In such situations, citizens must submit a new application to the Pension Fund within 30 calendar days.

The most serious consequences await those who deliberately violate the rules or fail to report changes. As warned by the Pension Fund, the amounts of benefits paid excessively due to abuses or non-provision of information about changes in circumstances are subject to return at the request of the agency.

'In case of refusal by the beneficiary to voluntarily return the excess paid benefit amount, the issue of its forced recovery is resolved in court,' the fund emphasizes.

Special rules apply under martial law. If the death of the beneficiary is established with a delay, the overpaid amounts are returned by their family members, but only from the month when the relevant civil registration record was made at the state registration authorities. These provisions are in effect during the martial law period and for another three months after its conclusion.

Experts advise citizens to pay attention when filling out documents and not to hide changes in life that may affect their eligibility for benefits. After all, reimbursement of overpaid amounts can become a serious financial burden on the family budget.
